We determine the purposes and means by which, and on the basis of which, personal data is used in our business activities. We are therefore to be regarded as the data controller within the meaning of the General Data Protection Ordinance (AVG).

1.3 OBLIGATION TO PROVIDE INFORMATION

We have the obligation to inform the individuals whose personal data we process about the how and why of those processing operations. We comply with this information obligation by means of this privacy statement.

1.4 CHANGES

This privacy statement was drawn up in August 2019. We may amend this declaration in the future. If we amend this privacy statement, the amended privacy statement will be posted on our website (www.heyelander.com), stating the date on which the amendments take effect. If there are changes that may affect you personally to a considerable extent, we will do our best to inform you immediately.

2. GOALS AND MEANS

2.1 HANDLING ORDERS

When you place an order with us, we use your personal information to process this order properly. We may then give your personal data to our delivery service to have the order delivered to you. We will also receive information about whether your payment has been completed. We will use your e-mail address, telephone number, IP address, billing address, and name and address. We need these because of the contract we’re signing with you.

We cooperate with certain companies that may receive the above mentioned personal data from us, and we cooperate with them for the processing of orders:
DHL Parcel, DHL Express Payment Providers: PAY.NL Foundation, PayPal, Sofortbanking and Mistercash Software Suppliers

2.2 YOUR ACCOUNT

Certain parts of our webshop require you to register first. You must then enter information about yourself and choose a username. With this we create an account, where you can log in with that username and a password of your choice. We use your name and address, e-mail address, IP address, billing address and telephone number for this purpose. We do this on the basis of your permission. We keep this information so that you do not have to fill it in again and again and so that we can contact you as part of the execution of the agreement. You can change the information in your account whenever you want.

2.3 CONTACT FORM AND NEWSLETTER

With the contact form you can ask us questions. For this we use: name, company name, e-mail address and a freely fillable note field. We have a legitimate interest in this. It also allows us to train our customer service to become even better. We offer a newsletter with which we want to inform interested parties about our products and/or services. Every newsletter contains a link to unsubscribe. You can also report this via your account. Your email address will only be added to the list of subscribers with your permission. This information will be kept until you cancel your subscription.

2.4 STATISTICS AND PROFILING

We keep statistics about the use of our webshop. With these statistics we improve our webshop to show only relevant information, for example. Of course we will respect your privacy at all times. If you don’t want this, you can always report it to us. For this purpose we use your interests and surfing behaviour, name and address, IP address, e-mail address, telephone number and billing address. We have a legitimate interest in this.

2.5 PROVISION TO OTHER COMPANIES OR INSTITUTIONS

With the exception of the above mentioned partners and partners who support us in our business operations, we will under no circumstances give your personal data to other companies or institutions, unless we are legally obliged to do so (e.g. if the police require it in the event of a suspicion of a criminal offence).

2.6 STATISTICS

We keep statistics about the use of our webshop. In our webshop you will find social media buttons. This allows the administrators of these services to collect your personal data.

2.7 GOOGLE ANALYTICS

We use Google Analytics to track how visitors use our store. We have entered into a processing agreement with Google. It contains strict agreements on what they are allowed to keep. We allow Google to use the Analytics information obtained for other Google services. We do not allow Google to anonymize the IP addresses.

3. HOW LONG DO WE KEEP AND PROCESS YOUR PERSONAL DATA?

We will process your personal data for a period of seven years after your last order, or as long as legally required or necessary and permitted for the purpose for which it was obtained. Immediately after these periods, we will destroy and/or anonymise your personal data. The criteria used to determine our retention periods include, but are not limited to: (i) the duration of our continuing relationship with you and the services we offer you; (ii) whether or not there is a legal obligation to which we are subject; and (iii) whether or not custody is advisable because of our legal position (such as applicable limitation period(s), a lawsuit or investigations by a regulator). Notwithstanding, we may process your personal data for an extended period of time (i) to comply with legal retention periods (e.g., laid down in tax law) or (ii) to prove that we comply with applicable legal obligations (e.g., in relation to the AVG or e-mail marketing law).

4. SECURITY

We will take appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access or against any other unlawful or unlawful processing of such personal data. Taking into account the state of the art and the cost of implementation, these measures shall ensure a level of security appropriate to the risks associated with the processing and the nature of the data to be processed. For example, we use a secure SSL connection during the ordering process and when filling out the registration form.

5. TRANSMISSION OUTSIDE THE HONOR

It is possible that we – or the contractors engaged by us – transfer your personal data to an organisation in a country outside the European Economic Area (EEA) and that that country has a lower level of protection with regard to personal data than the protection on the basis of the AVG and other regulations within the EEA. If such a situation arises, and personal data is transferred to a country outside the EEA that offers less legal protection to personal data, we will provide appropriate safeguards to ensure that the transfer takes place in accordance with the applicable privacy legislation. Apart from this, we – or the contractors engaged by us – may transfer personal data to an organisation in a country outside the European Economic Area (EEA), which country has a lower level of protection with regard to personal data than the protection on the basis of the AVG and other regulations within the EEA, in the event of a statutory exception as referred to in Article 49 of the AVG (e.g. on the basis of your explicit consent or necessary in order to be able to carry out an agreement that is of interest to you). 6. PROCESSING BASED ON YOUR CONSENT

If we process your personal data on the basis of your explicit consent (basis), you have the right to revoke this consent at any time. If you wish to revoke your consent, we will no longer process your personal data for the purpose for which you revoke your consent. The revocation of your consent does not affect the lawfulness of the processing of your personal data prior to the revocation of your consent.

7. AUTOMATED DECISION-MAKING

We do not use fully automated decision-making processes with regard to you.

8. YOUR RIGHTS AS A DATA SUBJECT

With regard to the processing of personal data, you always have the right to contact us:
– to have access to the personal data we process about you (right of access);
– to have your personal data corrected if they are incorrect (right of correction);
– to have your personal data deleted (right of deletion/right of oblivion);
– to have the processing of your personal data restricted (right of restriction of processing);
– to object to the processing of (a certain part of) your personal data (right of objection);
– to have your personal data disclosed to yourself or to have your personal data disclosed to another data controller (right to data portability).

The above mentioned rights are based on the AVG. However, these rights are not always applicable. The exercise of certain rights will require specific circumstances in order to be able to rely on them. We refer to Articles 15 to 18, 20 and 21 of the AVG for these specific circumstances. If you would like to make use of your rights, you can send us an e-mail (info@heyelander.com) with a description of which rights you are using and to which personal data the request relates. We may ask you to identify yourself if you exercise any of your rights. The reason for this is that we need to be sure that, at the request of the right person, we provide the right personal data or process it in some other way. If we cannot allow a request from you to exercise any of the above rights, we will substantiate in writing why we are unable to do so.

9. COMPLAINTS

If you have a complaint about the way in which we handle your personal data, we will gladly try to solve it with you first. In that case you can send an e-mail to info@heyelander.com. However, in the event of a complaint regarding the way in which we process personal data, you are also free to submit a complaint directly to the Personal Data Authority.
